By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. Before any app content is displayed, we prompt users to agree to our privacy policy and terms and conditions. By clicking that “I Agree” button within the app, you further are agreeing that you have read and agree with the terms and conditions contained on this page. CHOICEMARKET TECHNOLOGIES LLC and the creators of the application will under no circumstances be held liable for a user’s negligence associated with operating the app and / or training equipment improperly, or for the violation of any of the terms and conditions described here.
Compliance with Federal, State, and Local Laws regarding firearm ownership and usage. It is the responsibility of the user of this app to Familiarize yourself with and obey all Federal, State, and local laws regarding the purchase, possession, carrying, use, storage, and disposition/sale of firearms as per the Federal ATF guidelines, which can be found here https://www.atf.gov/firearms/learn-about-firearms-safety-and-security. It is the user’s responsibility to make sure that they are in compliance with any Federal, State, and / or Local laws while operating this application.
General Safety Terms and Conditions. Firearms are inherently dangerous and handling a firearm involves potentially deadly risk to yourself and those around you. Use an inert training platform while using any of our apps. It is your responsibility to make sure that you are trained, and that you operate any equipment safely. CRACKSHOT/ CHOICE MARKET TECHNOLOGIES LLC is not responsible for improper usage of our software and equipment. We do not provide any warranties for any equipment recommendations as they are third party vendors. This information is for your benefit only. Our apps should only be used after professional live training with approval from a trained and certified firearms instructor. Some drills within our apps may contain physical activity. Consult with your doctor before doing any sort of drills or exercises. The user of this app assumes ALL liability for their actions and holds the creator of the apps and the owner of the apps harmless. These apps are meant for educational purposes only and it is the user’s responsibility to verify that the content is safe and legal for themselves to operate before attempting to utilize the apps or CRACKSHOT Training Equipment in any capacity.
The user of the app must abide by these safety guidelines for dryfire practice. 1. The user will treat every weapon as if it is loaded, even if it isn’t loaded. 2. The user will never let the muzzle cover anything that they aren’t willing to damage or destroy. 3. The user will keep their finger off of the trigger until it is aimed at their intended target. 4. The user will always identify the target and what is behind it. 5. The user will place themselves in an individual environment free of distractions where they can focus solely on application usage. 6. The user will lock and remove all ammunition from the weapon and the general training area when training. All live ammunition should be stored in a completely different room. 7. If you’re training with a real firearm or platform, use dedicated dry fire safety equipment and dedicated dryfire targets. 8. When you decide that you have completed dry fire training, do not do any further training. Put your targets and weapons away, locked in a safe place as per firearms safety.9. Wait 1/2 hour after dry fire training before reintroducing any live ammo exercises. Keep the equipment separate and always check your firearm. 10. When you reload your weapon do so pointed in a safe direction, absent of any bystanders in the area, and audibly say “live weapon, live ammo” 5-10 times.
Remember, you must train safely. Your weapon, your equipment, and safe usage of weapon and equipment are the sole responsibility of the user.
General App Usage. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Choice Market Technologies LLC. Choice Market Technologies LLC is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for. You should be aware that there are certain things that Choice Market Technologies LLC will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Choice Market Technologies LLC cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left. If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply.
As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app. Along the same lines, Choice Market Technologies LLC cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Choice Market Technologies LLC cannot accept responsibility. With respect to Choice Market Technologies LLC’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Choice Market Technologies LLC accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app. At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Choice Market Technologies LLC does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
Changes to This Terms and Conditions We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes.
